1Service Provider
In this form, "Provider" means VISTA AI TECHNOLOGY LLC and "Buyer" means the consumer who purchases the service.
2Essential Features of the Service
Bilgi Ticareti is a software service (SaaS) accessed over the internet for creating, publishing and selling digital education and information products. The service does not include a physical product; it is used through a browser for the duration of the subscription.
2.1 · Included with the subscription
- Course and digital product creation, module and lesson structure, video hosting
- Sales page and funnel builder
- Email marketing and automation
- Webinar (live and automated) management
- Customer portal, order and subscription management
- Analytics and reporting
- Additional modules that vary by the selected plan
The current list and limits of the modules included in a plan are shown in the pricing section at the time of purchase and are an integral part of the agreement.
2.2 · Technical requirements
- An up-to-date web browser and an uninterrupted internet connection
- An accessible email address for account verification
3Price, Taxes and Payment
- The subscription price is shown on the purchase screen as a total amount including taxes, based on the selected plan and period (monthly or annual).
- No additional fee other than the amount shown is requested from the Buyer. Exchange-rate differences and foreign transaction fees that your bank or card provider may apply are outside the Provider’s control.
- Payment is taken by credit/debit card through the payment institution infrastructure. Card details are not stored on the Provider’s servers.
- The invoice is sent electronically to the email address on the Buyer’s account after payment is completed and can be downloaded from the customer dashboard.
4Performance, Term and Renewal
- Performance of the service begins electronically at the moment payment is confirmed; account access is opened immediately.
- Unless cancelled by the Buyer at the end of the selected period, the subscription renews automatically for the same period.
- A reminder is sent to the Buyer by email before renewal.
- The Buyer may cancel their subscription at any time, without giving a reason, from the subscription screen in account settings. Cancellation takes effect at the end of the current paid period; access continues until the end of the period.
5Right of Withdrawal and Its Exception
Under Article 15 of the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği), for services performed instantly in electronic form, the right of withdrawal cannot be exercised if performance has begun with the Buyer's consent.
Because a Bilgi Ticareti subscription is opened for access immediately after payment confirmation, it falls within this exception. For this reason, the Buyer is asked on the purchase screen to separately and expressly confirm the following statement:
- “I request that performance of the service begin immediately after payment confirmation, and I understand that in this case I will lose my right of withdrawal.”
Unless this confirmation is given, performance of the service does not begin. If it has not been given, the Buyer may exercise the right of withdrawal within fourteen (14) days from the date of the agreement, without giving a reason and without paying any penalty; in this case the amount collected is refunded within fourteen days.
The withdrawal notice is made in writing to destek@bilgiticareti.com.
6Complaints and Dispute Resolution
The Buyer may submit requests and complaints regarding the service to the Provider through the contact channels above. In the event of a dispute, pursuant to Law No. 6502 on Consumer Protection (Tüketicinin Korunması Hakkında Kanun) and within the monetary limits announced each year by the Ministry of Trade, the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) at the Buyer's place of residence or the place where the transaction was made have jurisdiction, and for disputes above those limits the Consumer Courts (Tüketici Mahkemeleri) have jurisdiction. The current monetary limits are published on the Ministry of Trade's website.
7Acceptance of the Form
Before completing the purchase, the Buyer confirms electronically that they have read this Preliminary Information Form and accept its contents. Without this confirmation, the payment step cannot be reached. The confirmed form and the Distance Sales Agreement are sent to the Buyer's email address after the transaction is completed and are stored in the customer dashboard.
