1.2 · Buyer

The natural or legal person who purchases the Service. The Buyer's first name, last name, email, phone number and billing address details are the information entered by the Buyer during purchase and stored in the order record.

2Subject of the Agreement

The subject of this agreement is the determination of the rights and obligations of the parties, in accordance with Law No. 6502 on Consumer Protection (Tüketicinin Korunması Hakkında Kanun) and the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği), regarding the sale and performance of the subscription service that the Buyer orders electronically through the Provider's website bilgiticareti.com and whose features and sale price are set out below.

The Buyer acknowledges that, before purchase, they have read and accepted the Preliminary Information Form and have obtained the Provider's legal name, full address and contact details, the essential features of the Service, its total price including taxes, the payment and performance terms, and the information on the right of withdrawal.

3Service and Price

  • The Service is a software subscription accessed over the internet (SaaS). It does not involve physical delivery.
  • The scope and duration of the subscription and its total price including taxes are determined by the plan details shown on the purchase screen and in the order summary. This information is an integral part of this agreement.
  • Payment is collected through the payment institution infrastructure (Stripe) by credit or debit card, or by bank transfer (havale/EFT). Card details are not stored by the Provider.
  • The Provider reserves the right to change prices for future periods. Any change will be notified to the Buyer by email at least thirty (30) days before it takes effect and will apply only to renewal periods after the notice. The Buyer is free to cancel their subscription within that period.

4Performance, Term and Renewal

  • Performance of the Service begins electronically at the moment payment is confirmed, and the Buyer’s account is opened for access immediately.
  • Unless cancelled at the end of the selected period (monthly or annual), the subscription renews automatically for the same period and payment is collected from the saved payment method.
  • The Buyer is notified by email before the renewal date.
  • The Buyer may cancel their subscription at any time from the subscription screen in their account, without giving a reason. Cancellation takes effect at the end of the paid period; access to the Service continues until that date.
  • No payment method is requested for the free trial; charging does not begin automatically at the end of the trial period. Unless the Buyer selects a plan and pays to continue using the Service, only the limited scope available after the trial can be used.

5Right of Withdrawal

Under Article 15 of the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği), for services performed instantly in electronic form, the right of withdrawal cannot be exercised if performance begins with the Buyer's express consent.

The Buyer separately confirms on the purchase screen that they request immediate performance of the Service and that they will therefore lose the right of withdrawal. Unless this confirmation is given, performance of the Service does not begin, and the Buyer may exercise the right of withdrawal within fourteen (14) days from the date of the agreement.

If the right of withdrawal is properly exercised, the full amount collected is refunded to the payment method used, within fourteen (14) days from the date the withdrawal notice reaches the Provider. How long card refunds take to appear in the Buyer's account depends on the procedures of the relevant bank or card organization.

6Obligations of the Parties

6.1 · Provider

  • To provide the Service with the scope and features defined on the purchase screen.
  • To announce planned maintenance work a reasonable time in advance.
  • To process and protect the Buyer’s personal data within the framework described in the KVKK Privacy Notice (under Law No. 6698 on the Protection of Personal Data).
  • To respond to requests and complaints within a reasonable time.

6.2 · Buyer

  • To ensure that the information provided during purchase is accurate and up to date.
  • To keep account access credentials confidential and to be responsible for actions taken through their account.
  • Not to use the Service in violation of applicable law or the Terms of Use.
  • To be personally responsible for the lawfulness of the content and products they offer to their own customers through the platform.

7Termination

  • The Buyer may cancel their subscription at any time; cancellation takes effect at the end of the paid period.
  • If the Buyer materially breaches this agreement or the Terms of Use, the Provider will give written notice allowing a reasonable period for the breach to be remedied; if the breach is not remedied, the Provider may terminate the agreement.
  • In cases of hosting unlawful content, misuse of the payment system, or use that harms third parties, the Provider may suspend access without prior notice and will notify the Buyer immediately.
  • Upon termination, the Buyer is given thirty (30) days from the date of access to export the data they created on the platform.

8Force Majeure

Neither party can be held liable for the period during which an obligation cannot be performed due to natural disasters, war, widespread infrastructure or power outages, decisions of public authorities and similar force majeure events beyond the parties' control. If the force majeure lasts longer than thirty (30) days, either party may terminate the agreement without compensation.

9Dispute Resolution

For disputes arising from this agreement, pursuant to Law No. 6502 on Consumer Protection and within the monetary limits announced each year by the Ministry of Trade, the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) at the Buyer's place of residence or the place where the transaction was made have jurisdiction; for disputes above those limits, the Consumer Courts (Tüketici Mahkemeleri) have jurisdiction.

If the Buyer is a consumer resident in Türkiye, the Provider being resident abroad does not remove the Buyer's rights under Turkish consumer legislation.

10Entry into Force

This agreement, consisting of ten (10) articles, was formed and entered into force by the Buyer reading and accepting it electronically. A copy of the agreement is sent to the Buyer's email address after the order is completed and is stored so as to be accessible in the customer dashboard.
