1. Data controller

Pursuant to Personal Data Protection Law No. 6698 (“KVKK”), the data controller for the personal data of people who visit bilgiticareti.com, open an account on the Platform, or become partners is Vista AI Technology LLC (8 The Green, Suite A, Dover, DE 19901, USA). Contact: destek@bilgiticareti.com.

Important: For the student and customer data that Entrepreneurs collect on their own sites, the data controller is the relevant Entrepreneur; Bilgi Ticareti is the data processor for that data. The Entrepreneur’s own privacy notice applies to that data.

2. Data we process

Identity and contact: first name, last name, email, phone, and, where needed for invoicing, company name, VKN/TCKN (Turkish tax ID / national ID number), and address.
Customer transaction: plan, payment and invoice records, support correspondence.
Transaction security: login records, IP address, device and browser information.
Marketing: if you give consent, commercial message preferences, campaign interactions, and cookie data.
Visual/audio: the instructor photo you upload; webinar and meeting recordings (if recording is on).
For partners: commission and payment information.

Payment card details are not processed by us; they are processed directly by the payment service provider.

3. Purposes of processing and legal bases

Opening the account, providing the Platform, subscription and invoicing (KVKK Art. 5/2-c performance of a contract; Art. 5/2-ç legal obligation).
Information security, preventing misuse, managing legal claims (Art. 5/2-f legitimate interest; Art. 5/2-e establishment of a right).
Responding to support requests and improving the service (Art. 5/2-c, Art. 5/2-f).
Sending commercial electronic messages and non-essential cookies (Art. 5/1 explicit consent / consent under Law No. 6563).
Calculating and paying partner commissions (Art. 5/2-c).

4. Method of collection

Data is collected by electronic means through registration and payment forms, use of the dashboard, support channels, cookies, and the third-party accounts you connect (e.g., Google, YouTube, Instagram).

5. Transfers and transfers abroad

To the extent necessary to provide the service, data may be transferred to the suppliers from which we receive hosting, database, content delivery, email delivery, payment, AI processing, video meeting, and accounting services, and, where there is a legal obligation, to authorized public authorities.

A significant portion of these suppliers’ servers are located in the USA and the European Union, and the data controller Vista AI Technology LLC is based in the USA. For this reason, personal data is transferred abroad under KVKK Art. 9, within the framework of the standard contracts announced by the Personal Data Protection Board and other appropriate safeguards.

6. Retention period

Data is retained for as long as your account is open and afterwards for the periods prescribed in the relevant legislation (e.g., 10 years for invoice and accounting records) or for the limitation periods applicable to potential disputes; at the end of that period it is deleted, destroyed, or anonymized.

7. Your rights

Under KVKK Art. 11, you have the right to: learn whether your data is being processed; request information; learn whether it is used for its intended purpose; know the third parties to whom it is transferred; request correction if it is incomplete or inaccurate; request deletion if the conditions are met; request that these actions be notified to the parties to whom the data was transferred; object to a result against you that arises from automated analysis; and claim compensation for damage arising from unlawful processing.
